Southwest Iowa Citizens Taking a Stand For Our Country

 ---Public Officials and "Shameful Acts"-- Date: 2011-08-25
The purpose of Our Constitution and Our Bill of Rights are to keep Public Officials and Agents thereof from taking away our Unalienable Rights (God given Rights).
Are some Public Officials acting "Without Authority" and violating our Rights?
We the People are created in the image of God with certain Unalienable Rights. All people should live by the Golden Rule and treat others, as we would like to be treated.
Public Officials have been placed in a higher position of Honor to represent the Best of the Nation to protect our Unalienable Rights (God given Rights), both for their children and our children for the future of America. ---It is more blessed to give than to receive. He or She who wants to be the Greatest must be Servant to the People.
All Public Officials should aspire to be Honorable and it is the duty of the people to uphold the Public Officials who are willing to do the right thing to protect our Unalienable Rights (God given Rights).
It is also the duty of the people to hold accountable to the fullest extent allowed by the law all Public Officials and or Agents thereof who refuse to be Honorable.
The purpose of Our Bill of Rights and Our Constitution is to spell out what the boundaries are to help the Public Officials to better serve the people and protect our Unalienable Rights (God given Rights).
We hold these Truths to be self-evident, that all Men are created equal, that they are endowed by their Creator with certain Unalienable Rights… --- The Declaration of Independence
We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. ---Constitution ---
Below are some Laws and Penalties pertaining to Public Officials, who violate Our Constitution.
"This constitution shall be the Supreme Law of the Land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding." (U.S. Constitution, Article VI, paragraph 2.)
The purpose of Our Constitution and Our Bill of Rights are to keep Public Officials and Agents thereof from taking away our Unalienable Rights (God given Rights). –(This must start at our local level.)
Any Public Official and or Agent thereof who would take the Freedoms, Rights and Liberties from the American People and Our Children and Grandchildren are an "Enemy" of Our Constitution and Our Nation, "Shame on You". (This includes all School Officials)
How can any Public Official be a pillar of their community doing Dishonorable Acts against the People?
Constitutional scholars have stated that everyone in America opposed to or working against our Constitution is by definition a domestic enemy of Our Constitution: presidents,senators, congressmen, judges, bureaucrats, military, and police included. Meaning all Corrupt Public Officials and or their Agents therof. This is based upon "All laws repugnant to the Constitution are null and void." Marbury vs. Madison
Ga. Const. Art. I, § II, Para. I. Public Officials and Agents thereof are the Trustee and Servants of the people and are at all times amenable to them. (This pertains to all Local Officials also)
Failing to be Amenable to the People and "oppressing, threatening or intimidating" our Unalienable Rights shall cause Public Officials and Agents thereof to be Guilty of this Federal Criminal Law: Title 18 section 241 & 242: Any public official and or police officer who conspires to oppress, threaten or intimidate any citizen in the free exercise of enjoyment of any right or privilege secured to him by the Constitution of the Laws of the United States, or because of his so having exercised the same may be imprisoned for up to ten years. This is a Felony offense, so we may add Punitive Damages (51-12-5.1) against the violator of up to $250,000.00 per incident per person per Public Official and Agent thereof.
Public Officials "Without Authority":
5 USC § 3331: An individual, … elected or appointed in the civil service or uniformed services, shall take the following oath: "I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God."

What good is it for a Public Official and or Agent thereof to take an Oath just stating they will support the Constitution, but refuse to "Defend" it against Domestic Enemies? (Dishonorable Public Officials)
Unless Public Officials and or Agents thereof can produce their Constitutional Oath (5 USC § 3331) of office they are "Without Authority and Immunity" and subject to any penalties the Law may require such as Criminal Trespass against our Unalienable Rights and against the Public office they are occupying. O.C.G.A. 1-3-3 (20), 45-11-4, 16-7-21, 16-8-3 and Title 18 section 241 & 242
Oaths required: O.C.G.A. Title 45-3-1, 45-3-2, 45-3-10.1, 45-17-1 ---O.C.G.A. 24-7-20. & 24-7-21
O.C.G.A. 45-3-3: " Such oaths shall be written and subscribed by the persons taking them and accompanied by the certificate of such officer, which shall specify the day and year taken."
Failure to take and produce a copy of the Certified/Notarized (Certificate attesting to its Truth) Constitutional Oath (5 USC § 3331) may indicate all actions taken by any Public Official and or Agent thereof has been "Without Authority". Acting "Without Authority" and or against "the People" (Citizen's Unalienable Rights) may cause the Public Official to be Liable for Felony Offenses and subject to Punitive Damages. O.C.G.A. 1-3-3 (20), 45-11-4, 16-7-21, 16-8-3, 51-12-5.1 and Title 18 section 241 & 242
To date ---Mayor Steven W. Turner, Council members Robert D. Hodges, James Eubanks, Jimmy Clifton, Winfred L. Parker, Billy Davis, Geraldine Bell and Chief Nealie McCormick and his officers have failed to produce their required Constitutional Oath (5 USC § 3331) with required Certificate per open records request, to them.
We the People are not bound to respond to and or obey any Public Official and or Agent thereof who have not taken the Constitutional Oath (5 USC § 3331) of office and they are acting "Without Authority". ---O.C.G.A. 24-7-20; 24-7-21, 45-3-2 & (45-6-5. The public may not be estopped by the acts of any officer done in the exercise of an unconferred power.)
Dedimus potestatem is a Latin term which means "we have given the power" (When Public officials and or Agents thereof have not been given the Power they are "Without Authority") ---O.C.G.A. 16-1-3; O.C.G.A. Title 36-33-4
Are some Local Judges Guilty of violating the Laws?
Did Randall Chew sit as Judge of Magistrate and Juvenile courts at the same time he was the attorney for the City of Pelham, the attorney for Pelham Schools and the attorney for the Pelham Police dept.
Georgia Codes: 15-1-8. When judge or judicial officer disqualified: (a) No judge or Justice of any court, magistrate, nor presiding officer of any inferior judicature or commission shall:
(1) Sit in any case or proceeding in which he is pecuniarily interested; (getting paid for services)
(3) Sit in any case or proceeding in which he has been counsel….. (acting as City Attorney, School Attorney, etc).
Have other Judges violated any Laws?

Are some Public Officials Guilty of Illegal voting?
Is Mayor Steven W. Turner part and party (O.C.G.A. 16-2-20 to 22) with council members Robert D. Hodges and James Eubanks, Guilty of illegal voting for the Historic District. O.C.G.A. 36-30-6 & 45-11-4 (b) & (c). (Illegal to vote on any matter they have direct or indirect interest) Steven W. Turner and Robert D. Hodges have businesses located within the Historic District and James Eubanks lives in the Historic District. If so "Shame on You"
Any Public Official and or Agent thereof who would take the Freedoms, Rights and Liberties from the American People and Our Children and Grandchildren are an "Enemy" of Our Constitution and Our Nation, "Shame on You". (This includes all Local, City, County and State Administrators.)
How can any Public Official be a pillar of their community doing Dishonorable Acts against the People?
It is possible that some Public Officials and or Agents thereof have not understood these Laws causing them to violate and Criminally Trespass against our Unalienable Rights (God given Rights) (Sovereign Immunity) and this is how they have become an Enemy of Our Constitution and Our Nation? We would hope that any misdeeds by any Public Official and or their Agents thereof of Trespassing on our Unalienable Rights (God given Rights) and Destroying America have been because of not understanding the Laws that protect our Unalienable Rights, Freedoms and Liberties. Our rights come from Our Creator God, not from any Government or Public Officials and or Agents thereof.
Now that the Public Officials have been made aware of these Laws they must do the right thing by making amends and start honoring Our Constitution and Our Nation to support and defend against all enemies both foreign and domestic or face the Dire Consequences allowed by Our Constitution and all Federal, State and Local laws.
All People of Good Will must now come to the aide of Our Constitution and Our Nation.
The purpose of Our Constitution and Our Bill of Rights are to keep Public Officials and Agents thereof from taking away our Unalienable Rights (God given Rights).
We must teach this to our children and grandchildren before it is too late and America becomes ruled by a Dictator and we lose our Freedoms, Rights and Liberties Forever. (School Officials, are you listening)
All Public Officials and or Agents thereof must take and Honor the Constitutional Oath (5 USC § 3331) of their office, and Stop violating our Unalienable Rights (God given Rights).
There was a time in our Nation's history when it was shameful to Dishonor Our Nation. Shouldn't it be shameful once again for Local, State, or Federal Officials to be Dishonorable?

Purpose: To Protect Citizens from Public Officials Abusing their Power!
Our Founding Fathers were Public Officials willing to give their Lives to protect All Citizen's God given Rights! In order to form a More Perfect Union, Justice has to be established to Protect All Citizens from Public Officials becoming Corrupt and abusing their office.
§ Are Our Public Officials protecting Citizen's Rights or are they taking them away?
§ Are Our Public officials establishing Justice and insuring Domestic Tranquility or are they the problem?
Darkness comes upon any Community when some Public Officials conspire with certain Law enforcement officials to violate Citizen's Constitutional Rights.
§ Ga. Const. Art. I, § II, Para. I state: "Public officers are the trustees and servants of the people and are at all times amenable to them".
§ Ga. Const. Art. I, § I, Para. IX (2009): Right to assemble and petition, which grants every Citizen the right to ask (petition) Public Officials to do the right thing?

If Attorneys have sat as Judges ruling over cases where they personally have vested interest in the case, and/or been counsel for one of the parties involved then ---This is against the Law!
Do some Public Officials believe they are above these Laws and don't have to show "Just Cause" for their actions? Have they forgotten their Oath to serve each Citizen for the Good of the Community? Could it be they have been in office too long? Have they come to think they are our Masters and can treat us like Slaves they can Harass, Intimidate and Tax to Death?
Do some Public Officials believe Tax Paying Citizens don't have the Right to investigate and hold them accountable to Honor their Constitutional Oath for any Laws they may have broken and/or any time they may have oppressed any Citizens Civil Rights?
If the Laws pointed out to these Public Officials are still in effect, then:
§ Who is harassing and seeking to intimidate whom?
§ Why have some Public Officials forgotten to Honor their Oaths to serve Taxpaying Citizens?
§ Why have some Public Officials forgotten they are employees, whose Salary is paid for by Tax Paying Citizens?
We have already requested each Public Official show "Just Cause" why they don't have to Honor the Constitutional Laws they have been presented, and made aware of in the other notices (having been hand delivered to them). ---Absolutely none of them have shown "Just Cause"!
Notice to All Public Officials: "We wish to request that each Public Official cease and desist from harassing and seeking to intimidate any Citizen in their free exercise of their God given Inalienable Rights and/or any Citizen who is seeking to investigate and/or hold any Public Official accountable to their Oaths."
It is the Duty of every Citizen to help each Public Official become aware of these Laws holding them accountable for wrong doing, and asking them to do the right thing and start honoring their Oaths. All Citizens have a Duty to Support the Constitution to Protect All Citizens from Public Officials Abusing their Office! As a Community we cannot expect to find Peace, Security and Happiness unless we are willing to stand up for the Rights of the least person. By Our Failure to take Positive action, we shall be just as Guilty as those taking Our Freedoms away from us.

More and More Citizens are waking up to their Constitutional Rights. Public Officials must recognize what is happening in this Country, Are you as a Public Official and or Agent thereof aware of these Laws that ---Protect Citizen's God given Rights--- to provide Peace and Security to the Community and for the Good of America.

In order to have Peace and Security in our Nation All Public Officials must Honor their Constitutional Oath of office of being Servants to each and every Citizen regardless of the Citizen's skin color. Have you as a Public Official taken the Full Constitutional Oath of Office: ---5 USC-3331? ---If you have not, why not?
As Citizens of our Nation ---We must back and support All Public Officials ---Who Support, Defend and Honor the Constitution.
It is of utmost importance that All Public Officials and Agents thereof ---never break the Law, if they do violate the law they must stop immediately or they will undermine and destroy the Peace, Security and Welfare of the entire Nation. If any Public Official and or Agent thereof ---breaks any Law and or violates any Citizens Civil Rights, then this Official and his or her superiors may lose their Immunity and be guilty of Civil and or Criminal offenses.
When any Public Official and or Agent thereof violate any Citizens Civil Rights regardless of the color of their skin, Great Harm is done to our Community and Nation. If we don't stand up for the rights of each other we destroy our own Freedoms, Rights and Liberties.
These Rights do not come from Government Officials, Supreme Court Judges, etc, ---(they come from God).
Holding Public Office takes a Special kind of person because Public Officials don't receive the Respect from the Citizens for doing the Right thing. It is the Duty of each Citizen to Back up and Support each Public Official who is willing to stand Tall above the Rat Race and do the Right Thing.
When Citizens don't fulfill their Duty of Backing and Supporting Public Officials who are willing to do the Right Thing of Treating each Citizen as they would like to be Treated, how could these Public Officials continue to do the Right Things without our Support?
Public Officials of Good Will who don't have the Backing and Support of the Citizens may get dragged into the Gutter of Bad Politics, We as Citizens cannot allow this to take place. We as Citizens must fulfill our Duty of backing and supporting every Public Officials who is willing to do the Right thing.
Each Public Official must live by the Golden Rule for the Good of the Community, that our Community may have Peace and Security.
Don't we all wish to live in a Community of Peace and Security?
Each Public Official has to step up to a Higher Level and be above "Business as Usual".
Any Public Official who is willing to step up to this challenge and hold this Special office and do the Right Thing, must have the Backing and Support of the Community.
There are Laws that hold Public Officials accountable for wrongdoing who refuse to Honor their Constitutional Oath of office and refuses to do the Right thing.
More than likely each of you as a Public Official may have thought you were doing the right thing, but is it possible you may have been deceived into doing wrong because you were not aware of these laws?
Surely if you had known and understood all these laws, you surely would have done the Right Thing?
Now you may see you may have broken some of these Laws and that these very Laws can hold you Personally accountable, even to the point of losing your immunity and you being then sued in your Personal Capacity for Punitive Damages by each Citizen so damaged? Surely you will choose to do the right thing and have the backing and support of the Community and avoid being sued?
God tells us that there is No Law against having Good Will and treating others, as we would like to be treated.
Is not God asking each of us to do the Right thing, and then shouldn't every Citizen appreciate each Public Official who is willing to do the Right Thing?
We are asking you to do the Right thing and make amends, now that you have been made aware of these laws that you may have broken, which you may have been unaware of, so we can support you in honoring the Special office you hold.
Surely you want to obey God and be supported by all Citizens seeking to enjoy their God given Rights??
The Citizens of Good Will in the Community would like you as a Public official to choose to do the Right thing and we will back and Support you as long as you choose to do the Right thing.
We as Citizens know we may make poor choices sometimes and we want to be forgiven, when we are willing to make amends and do the Right Thing, so we should be willing to forgive you when you have made poor choices, as long as you are willing to do the Right Thing and make Amends.
It is not our wish to get rid of any Public Official who is willing to do the Right Thing and try to live by the Golden Rule..
We need Public Officials who are of Good Will!
Any Public Official, who is willing to do the Right thing and immediately make Amends when their wrongdoings are brought to their attention, will not need a Lawyer!
Remember: Our God given Rights, Freedoms and Liberties are ----"Off Limits"---- to All Public Officials.

The Good People of America have allowed the Money Changers to take over and remove the Godly Principles our Constitution was built on from America, ---while we sat in church and did nothing about it.
Matthew 21:12-13 (New King James Version) ---Jesus Cleanses the Temple: ---12 Then Jesus went into the temple of God and drove out all those who bought and sold in the temple, and overturned the tables of the money changers and the seats of those who sold doves. 13 And He said to them, "It is written, ‘My house shall be called a house of prayer,' but you have made it a ‘den of thieves.'"
The Local Precincts are the same as the Temple, Parish, etc., but Jesus Christ calls them a "Den of Thieves". ---Some Local Party Bosses are the Moneychangers in the Temple.
The problems begin when the Democrat or Republican Party Bosses put in any Anti-God public official at local level. ---How is any election going to change anything as long as we allow Local Precinct Bosses to do Business as usual. ---How do we expect to have or keep our God given Freedoms, Rights and Liberties?
As long as we don't stand up and demand All Local Precinct Bosses support Godly people who will Honor our Creator God and the Constitution and remove All Un-Godly Public officials, how do we think anything is going to get any Better?
As long as people in our area churches don't start standing up for Public Officials who will uphold Godly Principles and support and defend our Constitution, How do we expect any improvement?

Why has the President left out the word "Creator" in several of his recent speeches? ---Why has the President rejected our Creator God and thinks our Constitution is just an old piece of paper he doesn't have to Honor? ---How can America recover, if the President doesn't Honor our Creator God and our Constitution?
The problem starts with the Local Precinct Bosses, if we allow the Local Party Bosses to keep doing Business as Usual.
Today's decline of America is because the Majority of Good People are not voting, nor or we supporting Politicians willing to Honor Godly Principles.
We have allowed a small minority of Evil Anti-God Liberals to make us believe they are the Majority ---and we have sat on our Butts in church convincing ourselves that we shouldn't get involved thinking God will do our work for us. We have refused to follow Jesus Christ example and kick these Evil Anti-God Liberals out of office in America.
The future of this Nation will be determined by what choice Americans make, do we continue to allow Godly Principles to be Trashed and Trampled upon in our Country ---or once again vote into office and Backup and Support Politicians who Honor Godly Principles and become the Hope for Freedom for all the world.
Let us finish the House cleaning in our Local Towns and Cities, Now is the time to Remove Local Precinct Bosses and other Public Officials who reject our Creator God and who are Trashing and Trampling on our Constitutional Rights.

When these Rights are taken away from any Citizen, be it by any Government Officials, Supreme Court Judges, etc the entire Nation must stand up to protect these rights or we shall lose them our self.

Isn't it the Duty of all people of Good Will, especially the church going Citizens to stand up for the God given Rights of the least persons of our Nation?
Have we failed our fellow man by our Lack of concern for their God given rights?

Why does our Nation have so many problems at this time? ---Surely Goodness and Mercy shall follow you all the days of your life. (Psalms 23:6) ---Why don't we find enough Goodness and Mercy in our Nation today? ---Is it because we have not shown Goodness and Mercy to our Fellow man?
No Public Official is above the Law when they violate any Citizens Constitutional Rights.

CASE LAW ON JUDICIAL IMMUNITY: ---Judicial immunity does not exist for judges who engage in criminal activity or aid and abet in criminal activity. The United States Supreme Court has stated that "if a court is without authority; its judgments and orders are regarded as nullities." Elliot v. When a judge acts as a trespasser of the law or when he does not follow the law, he loses subject matter jurisdiction and all of his orders are void or have no recognizable legal force or effect.
The United States Supreme Court further stated that "when a state officer acts under a state law in a manner violative of the Federal Constitution, he comes into conflict with the superior authority of that Constitution and he is in that case stripped of his official or representative character and is subjected in his person, to the consequences of his individual conduct. The State has no power to impart to him any immunity from responsibility to the supreme authority of the United States." In this capacity, the United States Supreme Court has indicated that "no state legislative or executive or judicial officer can war against the Constitution without violating his undertaking to support it." No public officials (elected and or appointed) who are required by law to take the Constitutional Oath of office shall be immune from Guilty charges when they also violate the Constitution, and Break the Supreme Law of the Land? ---It is every Citizen's duty to support Law and order; it is also our duty to remove any Corrupt Public officials from office.
